Court rejects woman's claim faulty bed left her paralyzed during sex

A British woman’s multimillion-dollar claim that she was paralyzed after being “catapulted” from her new bed during sex was rejected by the United Kingdom’s high court, BBC reported.

Claire Busby, 46, said she suffered a serious spinal injury after switching sex positions on her double divan, which she had only been using for a week. She blamed the “defective” bed supplied by Berkshire Bed Company and sued them for $1.3 million.

But her claim was deemed as a “tragic accident” by the UK’s high court.

Busby, from Berkshire in southeast England, told the court she was injured in August 2013 during sex with her then-partner John Marshall. She was kneeling and decided to change positions when she claims the bed launched her.

“I spun around, I put my hand down and then I felt like I was catapulted off the back of the bed,” she said.

The mom-of-four said she also hit her head on the floor and heard “like a spring in my body snap.”

But the high court concluded the bed was “not defective” and the “simple accident” was the result of “a most unfortunate and unusual combination of positioning on the bed and movement.”

“I am not satisfied that the difference in level between the two divans played any part in Ms. Busby’s loss of balance backwards,” Judge Barry Cotter said.

“This was a simple but tragic fall,” he concluded. “She simply overbalanced probably in part because she was sitting on a mattress as opposed to a firm surface, and underestimated the amount of give underneath her body.”
