Armenia proposes to considerably increase fines for selling unregistered drugs

At its January 12 sitting, the Health Commission of the National Assembly of Armenia approved the draft amendments to the Law on Drugs and Neighboring Laws which proposed to toughen the fight against importation of illegal drugs.

In particular, according to the head of the Commission Narek Zeynalyan, it is proposed to cancel the requirement to notify pharmacy managers about the upcoming inspection three days before the inspection, and raise fines for selling medicines not registered in Armenia.

He noted that due to notification about the inspection, when the inspection came to the pharmacies, everything was in order, and it turned out that the inspection body spent money, time and resources, but ineffectively. According to the new draft amendments, pharmacy employees are considered to be notified from the moment the inspector presents a written notification, while the presence of the head of the pharmacy is not required. It is also proposed to empower the inspection body to make a control purchase, and allow the return of purchased drugs right on the spot, after checking their legality by scanning control stamps.  

The current law sets a fine of 150,000 drams for finding up to 30 packages of unregistered drugs, and 350,000 drams for more than 30 packages. "These are quite low fines, and unscrupulous businessmen easily paid them, because the drugs imported illegally were sold at a fairly high price, and it was profitable," Narek Zeynalyan explained.

According to him, the amendments propose to fine up to 5 units of unregistered drugs at AMD 1 million, and for the amount of more than 5 units - AMD 2 million. In case of another violation within a year, the pharmacy's license will be suspended for 2 months, and if the pharmacy commits a violation again, it will lose the license.
